Effective March 1, 2026, federal Anti-Money Laundering regulations issued by the Federal Financial Crimes Enforcement Network (“FinCEN”) require reporting for transfers of residential real property (1-4 dwelling units, including condominiums) to legal entities, trusts, shell companies, and similar legal structures. Accordingly, if you intend to bid or purchase property at a forthcoming Provident Law® foreclosure sale in the name of an LLC, corporation, trust, partnership, or other legal entity, you will be required to provide all additional information, documentation, and/or certifications regarding vesting and beneficial ownership if the entity or trust is the highest bidder, to the Trustee within three (3) days following the sale, before a Trustee’s Deed will be issued. Failure to timely provide the required information to the Trustee will delay issuance and recordation of the Trustee’s Deed with the appropriate county recorder. These requirements do not apply to individual bidders.

The trustee then conducts a public auction, taking bids for the real estate in question. The highest bidder takes ownership to the property through a trustee’s deed. If no one bids on the property, the lender can claim the property.
